Do You Need a Business License to Sell on Etsy?

Etsy does not require a business license, but local rules may. Learn what to check by location, which registrations differ, and how to plan a viable Etsy shop.

Etsy does not require a business license simply to sell on its marketplace. Your government may still require licenses, registrations or permits for the business you run. The answer depends on your country, state or region, city, products and business activity.

That distinction comes directly from Etsy's shop-opening help page, checked October 31, 2026: Etsy's platform requirement does not remove applicable small-business laws.

This guide provides general information, not a determination for your address or product. Use the official sources below to identify the right authority before taking orders.

Etsy's rules and government rules are separate

Opening an account answers one question: can you use the marketplace? It does not settle every requirement for operating a business.

Etsy's Seller Policy, checked October 31, makes sellers responsible for applicable laws and regulations, including relevant product labels and warnings. The policy is a marketplace contract. Government permission is a separate check.

Keep a short record of what you found, the official URL, the date and any question you still need answered. If guidance is unclear, ask the issuing authority or an appropriately qualified adviser about your specific facts.

What do people mean by “business license”?

The search phrase can refer to several different documents. Use this table to frame your questions, rather than assuming every row applies to you.

Item to ask aboutQuestion to put to the relevant authority
General business licenseDoes operating this activity at my address require permission?
Business registrationDo I need to register this business or trading name?
Sales-tax or seller registrationWhat registration and filing duties apply to these sales channels?
Home-business permissionAre there restrictions on making, storing or shipping products here?
Product-specific approvalDo the materials, intended users or claims create extra requirements?

A business name, tax ID, marketplace account and license are not interchangeable answers. If an application asks for a document you do not understand, clarify what it is before applying for something else with a similar name.

In the United States, check state and local requirements

The US Small Business Administration's launch guide, checked October 31, says license and permit requirements vary with your activity, location and government rules. Its guidance includes state, county and city checks, and notes that zoning can apply to home-based businesses.

Use your state government's business portal and your city or county's licensing office. Describe what you make, where you make and store it, whether customers visit, and the channels through which you sell. “I sell on Etsy” is only part of the description.

For example, a seller making products in a home workshop should ask about that activity and address. Someone selling digital files should describe that model instead. Do not copy the answer given to a seller with different products or a different location.

The practical output is a list of requirements confirmed for your situation, with application and renewal steps where relevant. Avoid collecting registrations just because a generic checklist mentions them.

Sales-tax registration is another check

Do not assume that a marketplace handling a transaction resolves every registration or tax obligation you may have. Ask the revenue authority about your complete business, including sales outside the marketplace.

As a concrete example, California's seller's permit FAQ, checked October 31, describes permit requirements for businesses selling taxable tangible goods and directs readers to the authority for their circumstances. That general page alone does not determine how marketplace-specific exceptions apply to an Etsy-only seller.

Take a factual summary to the relevant authority: where you operate, what you sell, whether you also sell at events or through your own site, and where customers are located. Ask which current rules apply to that combination.

Keep the registration question separate from income reporting. If you need help interpreting your obligations, ask a qualified tax adviser. An online calculator or AI answer cannot confirm your individual tax position.

Outside the US, use your own country's guidance

A US checklist is not a universal rule. Start with your national business portal, then follow its route to regional and local requirements.

For the UK, GOV.UK's sole-trader guide, checked October 31, covers recordkeeping and points to checks for licenses, permits, online selling and working from home. It does not say that every online seller needs the same license.

If you sell internationally, also identify the rules relevant to the products and markets involved. Keep the first launch focused if that makes it easier to understand delivery and compliance. Expanding the list of countries should be a deliberate decision.

When asking for advice, include your country and local area in the first sentence. That makes it easier for an authority or adviser to distinguish relevant guidance from a superficially similar answer elsewhere.

A practical check before opening your Etsy shop

Gather the information an authority will need before you start searching:

  • Your operating address and the places where you make or store products
  • The exact product, materials and intended customer
  • Whether you use a trading name or registered business
  • Your sales channels, including markets and your own website
  • The countries or regions you intend to serve

Then work through the official sources. Save any written answer and record the date. If a rule depends on a threshold or exemption, check its definition rather than relying on a social-media summary.

Do not treat this exercise as a reason to postpone all preparation. You can work on product samples, photographs and a cost sheet while checking what must be completed before trading. Keep any required approval as a clear launch dependency.

How to make money on Etsy: begin with the unit economics

Having the right permissions does not establish demand. Choose a product you can produce consistently and price it around the full job.

Build a worksheet with the selling price, materials, packaging, production time, platform and payment fees, shipping costs you absorb, and an allowance for mistakes or returns. Include the time spent photographing, listing and answering questions.

Etsy's Fees & Payments Policy, checked October 31, lists a US$0.20 listing fee and a 6.5% transaction fee, with other fees and conditions described separately. Read the current policy and the terms shown for your account. Those two figures are not the full cost of a sale.

Here is an invented planning example: a $30 sale with $9 of materials, $2 of packaging and $4 reserved for applicable selling costs leaves $15 before labor, tax and overhead. If making and handling the order takes an hour, there is much less room than the revenue number suggests. The $4 reserve is an assumption for the example, not a calculated Etsy fee quote.

Change the assumptions until the offer can support the work. Do not use a higher sales target to hide a loss on each order.

Improve one small product range before expanding

Start with a few related items that solve the same buying need. Make the differences easy to understand: dimensions, material, finish, personalization and delivery time.

Use photographs that accurately show what the buyer receives. Write down the questions a customer would ask before ordering, then answer them in the listing. The product description checker can help find missing information, but does not certify a listing against every Etsy policy.

Treat the first listings as a test. Record views, enquiries, orders and the work needed to fulfill them. If people ask the same question repeatedly, improve that part of the listing. If they buy but the production process is unworkable, fix delivery before adding more products.

Set a realistic limit for custom orders. Clear options and a written approval process can help prevent a small sale from becoming an unlimited design project.

Can AI help with an Etsy business?

Use it to organize a naming brief, draft descriptions from confirmed facts and explore marketing ideas. Keep responsibility for the product, claims, permissions and customer service.

Etsy's Creativity Standards, checked October 31, allow seller-prompted AI creations within the designed-by-a-seller category and require disclosure in the listing description. They also exclude AI prompt bundles from that category. Check the exact policy for the item you intend to list.

For this reason, an AI-assisted business plan and a compliant Etsy listing are separate outputs. Do not assume a generated product is eligible for sale simply because a tool can produce it.

The SoGood Etsy-shop workflow, checked October 31, describes help with brand, product imagery, a separate website and marketing content. You still create and manage the Etsy shop and remain responsible for its rules and legal setup. The linked workflow is not an Etsy integration or licensing service.

Frequently asked questions

Do I need a business license to sell on Etsy?

Etsy's help page says the platform does not require one. Your country, state or region and city may have requirements based on the business and products. Check the sources above for your situation.

Do I need an LLC to sell on Etsy?

Do not confuse a company structure with a business license. The appropriate structure depends on your circumstances and local rules. The SBA guide separates choosing a structure from applying for permits; neither step answers the other automatically.

Does selling from home mean I do not need permits?

No blanket exemption should be assumed. The SBA's guidance includes home-business zoning checks. Ask your local authority about your actual activity and address.

Will Etsy sales automatically make a profit?

No. Build a realistic cost sheet and test demand. Revenue before fees, materials and your working time is not the amount you keep.

Can SoGood arrange my business license?

Do not treat SoGood's brand, website and marketing work as government registration, legal advice or tax services. Confirm the required applications with the responsible authority.

Prepare the shop and the business together
